Terms and Conditions of Rental

Occupancy

  • The Guest agrees that no more than the agreed number of persons shall occupy the property at any time during the rental term. All occupants must comply with the conditions and restrictions outlined in this agreement.

Condition and Use of Property

  • The property is provided in an “as is” condition. While the Rental Agent will make every effort to ensure all amenities (e.g., internet access, satellite/cable TV, hot tubs, fireplaces) are operational, they cannot be held responsible for any failure. Any reported issues will be addressed promptly.
  • Guests acknowledge that the use of amenities, such as hot tubs, pools, fireplaces, or decks, involves potential risks, especially for children. Such use is at the Guest's own risk.
  • The property is for residential use only and must be treated with care to prevent damage or loss. Guests must keep the property clean and refrain from loud noise, disturbing neighbors, or engaging in unlawful or offensive activities.

Default

  • If the Guest fails to comply with the terms of this agreement, they must vacate the property, remove their belongings, and leave the property in good condition. No refunds will be issued, and the prevailing party in any legal action will be entitled to reimbursement for legal costs.

Assignment or Sublease

  • The Guest shall not assign or sublease the property or allow its use by anyone not listed as an occupant in the booking agreement.

Risk of Loss and Indemnification

  • The Guest's personal property, furnishings, and belongings are their sole responsibility. The Rental Agent is not liable for theft, damage, or loss of personal items.
  • Guests agree to indemnify and hold the Rental Agent, property owner, and their representatives harmless from any claims, damages, or costs arising from property damage, injury, or loss of life sustained on the property.

Release

  • Guests waive claims against the Rental Agent, property owner, and their representatives for injuries or death sustained on or near the property. Use of amenities or facilities is entirely at the Guest's own risk.

Entry and Inspection

  • The Rental Agent reserves the right to enter the property at reasonable times with prior notice for inspections or showings. In cases of imminent danger, the property may be entered without notice.

Unavailability of Property

  • If the property becomes unavailable due to unforeseen circumstances, the Rental Agent will make every effort to provide a comparable replacement. If no replacement is available, all payments will be refunded, and the agreement will terminate.

Additional Terms

  1. Booking Requirements:

    • Guests must be 18 years or older to book.
    • The Rental Agent reserves the right to refuse bookings for any reason.

  2. Check-In and Check-Out:

    • Check-in is after 3 pm, and check-out is by 10 am unless otherwise agreed.
    • Failure to arrive by midnight on the start date without prior notice may result in booking cancellation.

  3. Occupancy Limits:

    • Exceeding the maximum occupancy violates Health and Safety Regulations. Excess occupants may be required to vacate or incur additional charges.

  4. Payment and Deposits:

    • Full payment must be received within the required timeframe; failure to do so may result in cancellation and forfeiture of the deposit.
    • Card details are required for breakages/damages and may be charged within 5 working days of departure if:
      • No damage is caused to the property or contents.
      • No charges are incurred for illegal activity, pets, or additional services.
      • The property is left clean, with rubbish discarded, dishes washed, and keys returned.
      • No linens are lost or damaged.
      • There is no early arrival or late departure.
      • Smoking does not occur within the property.

  5. Cleaning and Smoking:

    • The property must be left in a reasonable state upon departure. Additional cleaning costs may apply if necessary.
    • Smoking within the property incurs a £100 specialist cleaning fee.

  6. Pets:

    • Pets are not permitted in some properties. Guests must check individual listings for pet policies.

  7. Cancellations and Modifications:

    • Cancellations or modifications made up to 28 days before arrival incur no charges unless otherwise stated at booking.
    • Cancellations made within 28 days of arrival or no-shows will result in the full booking amount being charged.

  8. Lost Keys:

    • Guests are issued one set of keys unless otherwise agreed. Lost keys will result in locksmith charges.

General Provisions

  • This agreement constitutes the entire agreement between the parties. Amendments must be in writing and signed by both parties.
  • The agreement is governed by the laws of the United Kingdom.
  • Any waiver or failure to enforce a provision does not constitute a waiver of future breaches.
  • If any provision is deemed invalid, the remainder of the agreement remains enforceable.
  • Notices must be sent to the contact details provided in this agreement.
  • Digital signatures are considered valid and binding.
